Your rights as a data subject

First of all, we would like to inform you here about your rights as a data subject. These rights are standardized in Articles 15 - 22 of the EU GDPR. This includes:

Rights of objection

Please note the following in connection with rights of objection:

If we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without giving reasons. This also applies to profiling in so far as it is connected with direct advertising.

If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection is free of charge and can be made form-free by contacting: DATENSCHUTZ@buehlermotor.com.

In the event that we process your data to safeguard legitimate interests, you can object to such processing at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data unless we can prove compelling reasons worthy of protection for the processing that outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims.

Purposes and legal bases of data processing

The processing of your personal data complies with the provisions of the EU GDPR and all other applicable data protection regulations. Legal bases for data processing result in particular from Art. 6 EU GDPR.

We use your data for business initiation, to fulfill contractual and legal obligations, to execute the contractual relationship, to offer products and services and to strengthen the customer relationship, which may also include analyses for marketing purposes and direct advertising. During the processing of your personal data the regulations of the EU GDPR, the BDSG (new) and other relevant legal regulations are always observed.

Your personal data will be processed exclusively for the purposes mentioned above or if there is a legal obligation to process (e.g. due to tax regulations) (Art. 6 para. 1 c EU GDPR).

Your consent is also a data protection permission regulation. Here we inform you about the purposes of data processing and about your right of revocation.

If the consent also refers to the processing of special categories of personal data, we will expressly point this out to you in the consent. Processing of special categories of personal data in accordance with Art. 9 of the EU GDPR only takes place if this is required by legal regulations and there is no reason to assume that your legitimate interest in the exclusion of processing prevails.

Transfer to third parties

We will only pass on your data to third parties within the context of legal regulations or with appropriate consent. Otherwise, data will not be passed on to third parties unless we are required to do so by mandatory legal provisions (transfer to external bodies such as supervisory authorities or law enforcement authorities).

Recipients of data/categories of recipients

Within our company, we ensure that only those persons receive your data who need it to fulfill their contractual and legal obligations.

In many cases, service providers (e.g. shipping, payment services, credit assessment, IT service providers, distributors) support our specialist departments in fulfilling their tasks. The necessary data protection agreements have been concluded with all service providers.

Transfer to a third country/Intention to transfer to a third country

Data will only be transferred to third countries (outside the European Union or the European Economic Area) if this is necessary for the performance of the contractual obligation, is required by law or you have given us your consent therefor.

If we transfer your personal data to a service provider or to group companies outside the European Economic Area, we guarantee compliance with the data protection level.

Data storage time

We store your data as long as it is needed for the respective processing purpose. Please note that numerous retention periods require that data continues to be (must be) stored. This applies in particular to commercial or tax storage obligations (e.g. German Commercial Code, Fiscal Code, etc.). If there are no further storage obligations, the data will be routinely deleted once the purpose has been achieved.

In addition, we may retain data if you have given us permission to do so or if legal disputes arise and we use evidence within statutory limitation periods of up to thirty years; the regular limitation period is three years.

Secure transmission of your data

In order to protect the data stored by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons, we use appropriate technical and organizational security measures. The security levels are continuously checked in cooperation with security experts and adapted to new security standards.

The data exchange from and to our website is always encrypted. We offer HTTPS as the transmission protocol for our website, in each case using the current encryption protocols. In addition, we offer our users content encryption for contact forms and applications via our online portal. Only we can decrypt this data. It is also possible to use alternative communication channels (e.g. post).

Obligation to provide the data

Various personal details are necessary for the establishment, performance and termination of the obligation and the fulfillment of the associated contractual and legal obligations. The same applies to the use of our website and the various functions it provides.

The context determines what data we process: This depends on whether you place an order online or enter an enquiry in our contact form, whether you send us an application or submit a complaint.

When you visit our website, we collect and process the following data:

In the context of a contact enquiry we collect and process the following data:

  • Phone, email
  • Information on wishes and interests

For online applications we collect and process the following data:

  • Surname, first name
  • Street address
  • Contact details, e.g. email, telephone
  • Date of birth, qualifications
  • In addition, we use data that we have legitimately obtained from publicly accessible directories (e.g. professional networks).

Contact form/Contact by email (Art. 6 para. 1 a, b EU GDPR)

There is a contact form on our website which can be used for electronic contact. If you write to us using the contact form, we will process the information you provide in the contact form to contact you and answer your questions and requests.

Here, the principle of data economy and data avoidance is observed, in that you only have to provide the data that we absolutely need to contact you. These are
surname, first name, company, department, street, house number, postcode, town, country, telephone, email and details of wishes and interests.

In addition, your IP address is processed for technical reasons and for legal protection. All other data corresponds to voluntary fields and can be entered optionally (e.g. for more individual answers to your questions).

If you contact us by email, we will process the personal data provided in the email solely for the purpose of processing your enquiry. If you do not use the forms provided to contact us, no further data will be collected. 

By completing and submitting newsletter registration forms you confirm that the information you provide will be transferred to the Sendinblue marketing platform and processed in accordance with the Terms of Use (https://de.sendinblue.com/legal/termsofuse/).

Advertising purposes for existing customers (Art. 6 para. 1 f EU GDPR)

Bühler Motor GmbH is interested in maintaining customer relations with you and sending you information and offers about our products/services (product and company news, trade fair invitations, etc.). We therefore process your data in order to send you relevant information and offers by email and post.

If you do not wish us to do this, you can object at any time to the use of your personal data for the purpose of direct marketing; this also applies to profiling insofar as it is connected with direct marketing. If you file an objection, we will no longer process your data for this purpose.

Applicant portal (Art. 6 para. 1 a, b EU GDPR

Thank you for your interest in working for Bühler Motor GmbH. We are aware of the importance of your data and process the personal data provided by you within the scope of the application form only for the purpose of the effective and correct handling of the application procedure and for making contact within the context of the application process. The data will not be passed on to third parties without your consent.

In the context of the application form, you will be asked to provide personal data. Here we observe the principle of data economy and data avoidance, in that you only have to give us the data which we need for the complete examination of your application documents, e.g. your curriculum vitae or the collection of which we are legally required. These mandatory fields are marked with an asterisk (*). For technical reasons and for legal protection, your IP address is also processed.

Without this data we cannot check your application documents, therefore our application system does not allow uploading of the application documents in this case. Of course, you have the option of providing voluntary information in the application form.

In order to protect the security and confidentiality of your data in the best possible way, we implement appropriate security measures. Your application documents are transmitted to us in encrypted form through our application system.

We store your data for the above purposes until the application procedure is completed and the relevant deadlines have expired - at the latest six months after receipt of a decision. However, you have the option of us storing your application documents for a longer period of time and comparing them with other vacant positions corresponding to your profile.

For this we need your consent, which you can give us by clicking the checkbox before uploading your application documents. In this case we store your data for 12 months. You can of course revoke your consent at any time without giving reasons with effect for the future by email to personal@buehlermlotor.de or by post to Bühler Motor GmbH, Personnel Department, Anne-Frank-Str. 33-35, 90459 Nuremberg, Germany.

Automated individual case decisions

We do not use purely automated processing processes to reach about a decision.

Integration of Google Maps

Use of SalesViewer technology:

This website uses SalesViewer technology from SalesViewer GmbH on the basis of the website operators legitimate interests  (Section 6 paragraph 1 lit.f GDPR) in order to collect and save data on marketing, market research and optimisation purposes. 

In order to do this, a javascript based code, which serves to capture company-related data and according website usage. The data captured using this technology are encrypted in a non-retrievable one-way function (so-called hashing). The data is immediately pseudonymised and is not used to identify website visitors personally.

The data recording and storage can be repealed at any time with immediate effect for the future, by clicking on www.salesviewer.com/opt-out in order to prevent SalesViewerÆ from recording your data.
